Event Liability Waiver

EXPRESS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

I acknowledge and understand that:

  1. I will be participating in casual group rides in the XXX area as part of the Global ElliptiGO Riders Club’s XXX (“The Event”);
  2. These rides may include worn road surfaces, potholes, sand, gravel, and a number of other obstacles that make it dangerous for cycling;
  3. There is no traffic control, medical personnel present, or other precautions that have been taken to assure my safety during The Event and I AM ASSUMING THE RISK OF BEING SERIOUSLY INJURED, MAIMED, OR KILLED during The Event;
  4. I am obligated to wear appropriate clothing during The Event, including a DOT approved helmet that is in good condition;
  5. I must use extreme caution when riding and ensure that my bike is in good working order before attempting to ride; By signing this waiver I am voluntarily waiving my right to sue or seek recovery from anyone or any entity associated with The Event for any injuries I might sustain in connection with The Event. This includes, in particular, The Global ElliptiGO Riders Club and its officers and directors as well as ElliptiGO Inc. and its employees and directors.
  6. I am also agreeing to indemnify anyone connected to The Event for injuries I cause someone else through my negligence or recklessness.

In consideration for being permitted to participate in The Event, I agree that:

  1. I HEREBY RELEASE AND DISCHARGE The Global ElliptiGO Riders Club and its officers and directors, ElliptiGO Inc. and its employees and directors, PT Motion Works, Inc. and its officers and directors and every person connected to The Event financially, physically, or otherwise (the “Event Supporters”) from all liability, claims, demands, losses, or damages caused or alleged to have been caused in whole or in part by any of their acts or omissions, INCLUDING NEGLIGENCE, in connection with The Events. This includes any injuries I sustain during The Events, including death, as well as any injuries I cause to other people;
  2. If I, anyone on my behalf, or anyone I injure makes a claim against any of the Event Supporters as a result of my participation in The Event, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THEM FROM ANY LITIGATION EXPENSES, ATTORNEYS’ FEES, LOSS LIABILITY, DAMAGES OR COSTS THEY MAY INCUR AS THE RESULT OF SUCH CLAIM;
  3. IF ANY PORTION OF THIS DOCUMENT IS HELD INVALID, THAT THE REMAINDER SHALL CONTINUE IN FULL LEGAL FORCE AND EFFECT;
  4. I EXPRESSLY AND VOLUNTARILY ASSUME THE RISK OF ANY INJURY OR DAMAGE RESULTING FROM OR ARISING OUT OF MY PARTICIPATION IN THE EVENTS;

I have read this express release and waiver of liability, assumption of risk and indemnity agreement. I fully understand its terms and have signed it freely and voluntarily without any inducement, assurance, or oral modification.
